Help in completing the online application form for the recognition of a temporary employment agency

To apply for your first or additional recognition of your temporary employment agency, complete the online application form

You will need some certificates, documents and information to do so. Below, you will find explanations of the certificates and documents, as well as guidance on how to complete the steps of the form are provided below.

  • Stap 1
    • You want to apply for your first license.

    or

    • You already have a license and you want to expand it with an additional activity
  • Stap 2

    Fill in the details of the applicant. The applicant may be:

    • A legal entity (company, non-profit organisation, etc.). This is only possible if the agency has already been established.
    • A natural person.

    Fill in the details of the registered office.

    Select the activities for which you are applying for (additional) recognition:

    • Temporary employment activity (general)
    • Temporary employment activities in the artistic industry
    • Temporary employment activities in the construction industry
  • Stap 3

    You must fill in the contact person in Belgium (section 2). This step is optional.

  • Stap 4

    If you are applying for a license on behalf of a legal entity, please provide the details of the authorised representative(s) here. The authorized representative is the person who is authorized to bind the legal entity and who will act on behalf of the legal entity towards the authorities.

    There can be multiple authorized representatives of the legal entity.

    The following attachment must be added:

    • The certificates of good conduct of the manager(s) and any other authorized representative(s) of the agency. This document can be requested from your municipality.
      For an additional application, you only need to add this attachment if there are changes regarding the managers/authorized representatives compared to the original recognition application.
  • Stap 5

    The person who is responsible professionally must meet at least one of the following conditions in order to carry out the temporary employment activities:

    • He/she has at least 3 years of professional experience at management level in the temporary employment sector.
    • He/she has a Master’s degree or equivalent, and has at least 10 years of professional experience in the temporary employment sector, in human resources or business management.

    Every person who is professionally responsible must provide proof that he meets the conditions. He/she must add a CV and supporting documents (for example, a copy of qualifications, employment certificates, statutes, contracts, etc.) to the file.

    The authorized representative and person who is professionally responsible can be one and the same person. There can also be multiple professionals responsible.

    The professional responsible is accountable for the proper conduct of the intermediary or temporary employment activities within the company. He/she does not need to have a specific function within the company and can even be an external person. His/her responsibility actually consists of ensuring that a certain level of quality and expertise is present in the company that wants to be active as a intermediary or temporary employment agency. If you opt for an external person, this person must always act in the name of and on behalf of your agency when carrying out temporary employment activities.

  • Stap 6

    State the license period and number of your agency here if it is already recognised in:

    • the Brussels Capital Region
    • the Walloon Region
    • the German-speaking community
    • another EEA Member State (European Union, Iceland, Liechtenstein, Norway).
  • Stap 7

    Attachment 1: A regular copy of the signed (and coordinated) articles of association of the legal entity. You only need to include this attachment if the situation has changed since the previous application for recognition.

    • The corporate purpose of your articles of association must describe temporary employment activities.
    • You can obtain this document from your notary. If the directors of the company include one or more legal entities, their articles of association must also be included.

    Attachment 2: A certificate from the office of the Federal Public Service Finance in your region showing that you do not owe any overdue tax, fines or interest.

    • Is your agency based abroad? If so, include one or more certificates from the equivalent service(s) in your country.
      • Do you, as foreign agency, already carry out activities in Belgium? If so, state ‘1000 Brussels’ as municipality.
      • What if you do not carry out any activities in Belgium yet? Include a written statement to this effect in the file.
    • Legal entities or associations formed less than 6 months ago do not need to include this certificate.

    Attachment 3: Proof via a certificate from the National Social Security Office showing that you do not owe any overdue sums, fines or interest.
    The NSSO refers to this certificate as C450.

    • Foreign agencies or persons include one or more certificates from the equivalent service(s) in your country.
      • Do you, as foreign agency, already carry out activities in Belgium? If so, include a certificate from the NSSO.
      • What if you do not carry out any activities in Belgium yet? Include a written statement to this effect in the file.
    • If you are not registered with the NSSO, include the certificate of non-registration.
    • Was your legal entity or association founded less than 6 months ago? If so, you do not have to include this certificate.

    Note: A statement from a payroll service provider about your NSSO status does not replace this NSSO certificate and does not count.

    Attachment 4: Proof showing that you do not owe any overdue sums, fines or interest to the Subsistence Security Fund.

    Attachment 5: The certificate proving that you have paid the surety to the Social Fund for Temporary Workers.

    You can request this certificate from the Social Fund for Temporary Workers. A bank statement proving that (the first part) of the deposit has been deposited is not sufficient.

    Is your temporary employment agency based abroad? If so, you must prove to the Social Fund that you have paid an equivalent surety abroad. If the Social Fund accepts the surety, you will receive a certificate confirming the equivalence. You must include this certificate here.

    Attachment 6: A list of all the operational headquarters of the temporary employment agency.

  • Stap 8

    Confirm that the details are correct and accept the terms.
